Restrictive Covenants
And the Grantors and Grantees hereby agree that the following covenants shall be binding upon their respective heirs, executors, successors, and assigns;
- The Grantees will not erect any house, building or structure without the prior approval of the Grantors and will make the plans available to the Grantors for inspection and approval;
- The Grantees will not erect any building closer than fifty (50’) feet to the nearest roadway without the prior approval of the Grantors;
- The Grantees will not keep any livestock including poultry on the property; no pets shall be kept on the property for the purposes of breeding for sale;
- The Grantees will not erect any temporary building or use any mobile home for temporary or permanent accommodation upon the lands described in Schedule “A” without the prior approval of the Grantors;
- The Grantees will not erect any out-buildings without the prior approval of the Grantors;
- The Grantees will not erect any docks, wharves, piers or water front buildings without the prior approval of the Grantors;
- The Grantees will not operate or cause to be operated a boat or any form of water transport on the two lakes known as Lake of the Woods and Black Point Lake with a horse power more than 10 hp;
- No travel trailer, house trailer, camper trailer, mobile home or tent is permitted to be parked or stored in front or on the side of the dwelling on the property herein described in Schedule “A”;
- The Grantees will complete the landscaping on the front lawn, and in addition, will have the final coat of paint on the exterior of all dwellings not later than twelve months from the start of excavation;
- All approvals given by the Grantors shall be in writing and under seal.
Although not part of the covenants, the following information has been provided by the developer:
- The minimum size of a one story home is to be no less that 1500 square feet; the minimum size of a two story home is 1600 square feet;
- There is no set time to build a dwelling if a property is purchased.
- Access to Five Island Lake for the use of all homeowners is opposite 130 Five Island Road .
